Judge to hear McBee election protest
The Honorable Roger Henderson will hear Glenn Odom’s appeal of the decision of the McBee Municipal Election Commission that ordered a new election. The hearing is scheduled for 1 p.m. today in the Chesterfield County courthouse.
In the MEC’s Oct. 4 written decision ordering the new election, MEC Chairperson Linda Sterling wrote that had the contested ballots of Simone Bracey, Sabrina DeJesus, Cindy Kirk and Robbie Lyles been counted Odom could have been elected. During the Sept 25 protest hearing Bracey, DeJesus, Kirk and Liles testified under oath that they voted for Odom.
“It is ordered that the results of the municipal election by which Shilon Green was elected to Town Council are hereby declared void and a new election is hereby ordered,” Stirling concluded.
John Parker, Odom’s attorney filed the appeal, which wants those four votes to be counted, thereby giving Odom a one- vote edge over Green for the second contested seat.
However, Butch Bowers, who is representing the MEC, contends that according to state and case law, the MEC’s only recourse is to order a new election.
